TERMS OF USE

These "Terms of Use" govern your use of the BookEazy Website hereinafter referred to as "Service" or "Website". The Service is owned and operated by BookEazy Technologies Private Limited (hereinafter referred to as "BookEazy") and is offered to you (hereinafter referred to as "Member") as per your agreement with and acceptance of this document (hereinafter referred to as "Membership"). By clicking the box entitled "I agree" as part of the sign up process, Members accept all items in the Terms of Use and agree to abide by and be legally bound by the Terms of Use. These Terms of Use are an ongoing contract between you and BookEazy and apply to your use of the BookEazy service and Website. These Terms of Use affect your rights and you should read them carefully.

By browsing, visiting and using the BookEazy Website, you accept and agree to abide by these Terms of Use. If you do not agree to these Terms of Use, you should not use the BookEazy Website. BookEazy, reserves the right, from time to time, with or without notice to you, to change these Terms of Use in our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by clicking on the "Terms of Use" located at the bottom of the pages of the BookEazy Website. The most current version of the Terms of Use will supersede all previous versions. Your use of the BookEazy Website or continued use of our service after changes are made means that you agree to be bound by such changes.

Definitions

Booking shall mean the booking effected, through BookEazy or otherwise, by a member for one or more Tickets in his/her favour for a particular Show.

EazyCode shall mean a confirmation number (with or without alphabets) or any other code generated in favour of a member when he/she completes a Booking through BookEazy.

Theatre shall mean any theatre or cinema complex that has agreed or shall hereafter agree to provide viewership to members in such terms and conditions as may be mutually agreed between BookEazy and the member.

Theatre Schedule shall mean the periodic schedules (weekly or otherwise) of the movies including information as to names, dates and timings of the movies to be screened during the week or any other defined period in addition to information of the screens on which each such movie would be screened .

Ticket shall mean the physical ticket issued by the Theatre, through its staff manning the Ticket Box-Office, after accessing the EazyCode which entitles the member to view the particular Movie booked by him/her or on his/her behalf in pursuance of a Booking while, inter alia, mentioning thereon the name the movie booked, the date and Start-Time of its screening, the seat number, the screen, and the Ticket Price.

Ticket Box-Office shall mean a special ticket counter or general ticket counter designated by the Theater and manned by its staff or employees for carrying out such functions as are stipulated herein.

Ticket Price shall mean the price of various classes of Tickets published by the Theatre from time to time.

Security Deposit refers to the refundable interest free security amount deposited by a member with BookEazy.

Service Fees shall mean the fees receivable by BookEazy from members in consideration of Services provided by the former to the latter provided the computation thereof shall correspond to one or more Tickets or sets thereof booked by a member or by any other formula or method as may be listed or given by BookEazy on the Website from time to time.

Show shall mean any specific movie or screening which is scheduled to be screened by the Theatre on a particular screen, date, ticket price classes and a Start-Time as reflected in the Theatre Schedule.

Start-Time means the time at which the screening of a particular movie is scheduled to start as per the Theatre Schedule.

Purchase Policy

Our goal at BookEazy is to make your movie-going experience as easy and enjoyable as possible. Our Purchase Policy is designed to provide you with the information you need to ensure a smooth transaction and trouble-free retrieval of your Tickets once you get to the Theatre. Please take a minute to read the following:

Pay on Arrival Service: BookEazy allows members to book their tickets online but pay for them on arrival at the Theatre. To protect against members making a Booking but not paying for tickets on arrival, BookEazy collects a Security Deposit from each member. BookEazy will send an invoice per Booking via e-mail to the member. The total amount on the invoice must be paid to the Theatre before collecting the tickets. Payment on arrival at the Theatre is a channel that BookEazy provides its members for convenience. Members are liable for payment of tickets booked using BookEazy irrespective of whether they choose to use this channel.

Payment at Theatre: Only the Ticket Price must be paid at the Theatre. The Ticket Price is as declared by the Theatre and does not include any BookEazy Service Fees or any other charges. Members will be issued tickets only on payment of total Ticket Price as reflected in the Booking.

No cancellations. No Refunds. No Exchanges: At the time of your Booking order, BookEazy will remove the number of tickets you purchase from the Theatre's inventory, reducing the number of seats available for the chosen show time. While this allows us to provide our customers with the clear benefit of guaranteed seats, it prevents BookEazy and our Theater partners from reselling tickets in the event that you do not attend your chosen Show.

In accordance with our Terms of Use, BookEazy does not offer refunds or exchanges of tickets booked on BookEazy. Before purchasing your tickets we urge you to confirm the Show details such as title, time and location of the movie you wish to see. We will not be able to offer any changes, updates, for example, reduce or increase number of tickets or change the price class. The total amount payable as per the Booking invoice will be payable at the Theatre. No changes to the Booking are permitted at the Theatre.

Picking up your tickets: Please read the online and e-mail confirmation pages carefully, as they provide you with important information about retrieving your tickets. You must present the EazyCode along with a mobile SMS or printed proof of the Booking e-mail when you arrive at the Theatre. Please be prepared to present some form of identification in the event that the Theatre requests it.

At the time of your Booking order, BookEazy shall provide the Theatre with information required to verify your identity and ensure hassle-free issual of booked Tickets to you on your arrival. This information includes your name, details regarding your Booking order, the Show, your EazyCode, and some form of contact information that may be requested by the Theatre in order to contact you in event of any changes to the Theatre Schedule.

You should plan to pickup your tickets before the Start-Time. Based on ticket issual and Ticket Box-office operational policies in effect at the chosen Theatre, BookEazy is not liable if Tickets are not issued to the member if he/she arrives forty-five minutes after the Start-Time, or sixty minutes before the Start-Time. In the latter event, the member may be requested by the Theatre to arrive at a more suitable time.

Booking Confirmation: If you do not receive an EazyCode (in the form of a confirmation page, SMS or an e-mail) after submitting Booking request, or if you experience an error message or service interruption, it is your responsibility to confirm with our Customer Service whether or not your order has been placed. The Booking details along with the EazyCode will be always available to you in your Account details under booking history. If you do not get the e-mail or the SMS you can view the booking history to confirm if the Booking was placed.

Only you may be aware of any problems that may occur during the booking process. BookEazy will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation. BookEazy will send an e-mail and an SMS to the e-mail address and mobile number on your account immediately after a Booking. It is your responsibility to ensure that the e-mail address and mobile number are accurate and working at the time of booking.

Pending tickets: Once booked, the tickets are classified as "Awaiting Payment" in your account under booking history. This implies that the tickets have been confirmed with the Theatre for the booked Show but you have not paid for them at the Theatre. Once you reach the Theatre before the Show and pay for your tickets, we will convert the status of your Booking to "paid". We will also attempt to notify you via e-mail or a mobile SMS that your account has been updated. Typically we get immediate payment confirmation from the Theatre. However, in some cases, it may take up to 24 hours to get payment confirmation. The Booking will not be marked as paid until we receive payment confirmation.

No-show: The act of booking tickets through BookEazy but not paying for them at the Theatre is referred to as a No-show. The Theatre will inform BookEazy if a member did a No-show and provide the Tickets that were reserved for the member as proof of a No-show occurrence. On receiving this information, the Booking will be marked "Unpaid" on the member account and the member account will be temporarily suspended i.e the member will not be able to login to his/her account and make further bookings. BookEazy will then bill the member's account for the total ticket amount as reflected in the pending Booking invoice along with an additional no-show payment processing fee. BookEazy will issue this new invoice, referred to as No-show Invoice to the member. No further bookings can be made until the member clears the total amount on this invoice. After receiving the invoice payment, BookEazy will reactivate the member account and the account can be operated as before.

In the event that you do a No-show and do not pay the No-Show Invoice, your account will remain suspended and the No-Show Invoice dues will remain on your account. As a member, you are liable to pay the No-Show Invoice amount to BookEazy. If you cancel your membership without paying the No-Show Invoice, BookEazy is entitled to recover the same from the Security Deposit.

The member's Booking will be deemed to be a No-show if the member fails to produce the matching EazyCode at the Theatre when collecting the tickets. If the EazyCode provided by BookEazy to the Theatre does not tally with the EazyCode given by the member the concerned Booking shall be deemed to be a No-Show.

Disputing a no-show: If a member wishes to dispute a no-show (and the associated No-show Invoice billed to his account) he must send BookEazy the Tickets issued to him by the Theatre for the Booking that is under dispute. Only the physical Tickets issued by the Theatre serve as valid proof of the member having arrived at the Theatre and paid for the tickets.

Refund of Security Deposit: In the event that your membership is canceled, BookEazy will refund your Security Deposit after subtracting any outstanding charges on your account. We issue a bank cheque in the name of the member as provided in the member profile. The cheque will be issued within a maximum of seven working days. The cheque will be delivered to the billing address on the member's profile.

Service fee: BookEazy's members pay a service fee for the facility to book online and pay on arrival at the Theatre. This service fee is paid directly to BookEazy and reflected on the member account in the form of tickets that the member can book through BookEazy. Each time the member books tickets, the account balance is deducted accordingly. If the member has no service fee (i.e. no tickets) on his account balance, he is not allowed to make further bookings until he refills his account by paying the service fee. The service fee includes service tax and other applicable charges wherever specified. The service fee is non refundable.

Pricing and Availability of Tickets: BookEazy sells tickets on behalf of our Theatre partners. BookEazy does not set ticket prices, determine show times, or control ticket availability and inventory.

The availability information on BookEazy applies only to those tickets (or seats) that were allocated (reserved) by the Theatre to BookEazy for sale via our service. Therefore, the availability of the Theatre may differ from that of BookEazy. While we may be sold out for a particular show, the Theatre may have tickets for that show or vice versa. We do not display nor provide availability information for seats that were not reserved for BookEazy.

Similarly, all promotions and other information regarding Theatre Schedules, pricing, ticket availability, discounts, special offers and other booking specific information applies only to seats reserved for BookEazy by the Theatre and not to other seats that will not reserved for BookEazy.

You will be responsible for paying all applicable taxes levied by the Theatre in connection with your purchase of any tickets.

Ticket Limits: When purchasing tickets on BookEazy you are limited to a specified number of tickets for each Show. You are entitled to only the number of seats that are ref lected in your Booking.

Seats: In many cases, based on Theatre policies, BookEazy may or may not allow seat selection during booking process. In either case, BookEazy cannot guarantee the seats selected during the Booking process. The actual seats assigned to you within the selected price class will be alloted on your arrival by the Theatre. You may request for a certain type of seat, however, only the Theatre will be in a position to inform you whether your request can be met.

Refusal of service at Theatre: The Theatre retains the right to refuse entry to a customer without prior reason. BookEazy is not liable in the case that this may happen to a BookEazy member.

Canceled or Postponed events: The Theatre reserves the right to change the Theatre Schedule or rates without prior notice. Occasionally, events are canceled or postponed by the promoter or exhibitor. Should this occur, BookEazy and/or the Theatre will attempt to contact the member as soon as possible. In a situation where the Theatre is unable to screen a Movie as per the Theatre Schedule due to any reason that cannot be attributable to BookEazy as a result of which the Member is not able to view the movie as per his Booking, BookEazy shall not have any liability towards the Member and the same shall not amount to No-show or breach of BookEazy's contractual obligations towards the Member. However, in such a situation, the Theatre may compensate the Member by refunding the value of the Ticket Price or by providing such alternative arrangements as may be provided by the Theatre as per its normal policy.

Membership Terms

Cancellation of Membership: You may cancel your subscription to BookEazy at any time, and cancellation will be effective immediately. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY OUTSTANDING SERVICE FEE BALANCE OR UNUSED TICKETS OR OUSTANDING PROMOTIONS ON YOUR ACCOUNT.

Audit: BookEazy reserves the right to audit your membership, including your referrals from time to time to check fraud, breach of this agreement or any illegal activity.

Members may not use spam to obtain referrals. You may not use spam to gather referrals, "Spam" includes
(a) Unsolicited e-mail, i.e., e-mail sent to people you do not know personally, unless those people have expressly asked to receive e-mail announcing programs of this type.
(b) Mass, bulk or "junk" e-mails of any kind, unless those people have expressly asked to receive e-mail announcing programs of this type.
(c) Use the net, chat room or message board postings that are unrelated to the topic of discussion of the particular news group, chat room or message board.

BookEazy reserves the right, in its sole discretion, to terminate the Membership of any Member.

If BookEazy has reasonable evidence that a particular member has used spam to gain referrals, it has the right to terminate the spammers' membership. In addition the member may be subject to government penalties and other legal consequences under the law applicable. Our anti-spam policy provides more details and is incorporated by reference into this agreement.

Your relationship with BookEazy: Your relationship with the company is that of an independent customer. You are not an employee or agent of BookEazy. Neither you nor other members are authorized to make any statement or representations on behalf of BookEazy, its website or referral program. BookEazy will not be bound by, or be liable for any statement or representation made by you or by any member of the referral program.

Your relationship with other members: You agree not to make any misrepresentations to any members' referrals or potential referrals regarding the Referral Program or BookEazy, including, but not limited to statements with respect to compensation typically received by members of the program or with the compensation that potential members are likely to receive.

Termination of any program or promotion: BookEazy may terminate the Referral Program or any other promotion at any time, by posting the termination on the website and sending an e-mail to your e-mail provided while registering for the service. It is your responsibility to inform the company if your e-mail address changes. You will cease to accrue earnings from the Referral Program as of the date of the termination notice.

Termination of membership: BookEazy may terminate your Membership without prior notice of your Material Breach of this agreement. "Material Breach" includes:

(a) Any violation of any of the provisions of this agreement
(b) Acting unlawfully in relationship to BookEazy or the website.
(c) If there is a breach of our Anti-Spam Policy.
(d) For providing incomplete, false, bogus or otherwise incorrect information to us.
(e) Creating duplicate or illegal Memberships. If your Membership is terminated due to Material Breach of this agreement, as provided above, your accrued earnings balance will be forfeited, and you will not accrue any further earnings following your termination. If your membership is terminated by BookEazy you may not re-enroll or join the program unless formally invited to do so by BookEazy.

Memberships are not transferable: Your membership, password and accrued points are personal to you and are not transferable. You may not allow anyone else to use your password, points or membership. You may not use anyone else's password or membership or act to accrue points for anyone else. You are responsible for keeping your password secret. BookEazy is not liable far any damage caused by any disclosure of your password. You may create a membership only for yourself; you may not establish Membership on behalf of anyone else.

Additional Terms and Conditions for "Refer a Friend" AND "Inform Group" program on BookEazy

If in BookEazy's opinion, there is any suspect or actual evidence of electronic or non-electronic tampering with any portion of these Program or Referral Rewards, or if a computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of either Program, BookEazy reserves the right at its sole discretion to disqualify or discontinue the participation privileges of any individual involved in any such harmful or illegal activities, and to modify or suspend the Program, or to terminate the Program. Discontinued participation privileges may result in the loss of all accumulated rewards benefits. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, BookEazy reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any website associated with this Program via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible, in addition to any other remedies available in law or in equity. Use of automated, programmed, falsified or the like entry devices or programs is prohibited and all such entries are void.

By participating in this Program, you agree and give consent to BookEazy to transmit emails, SMSes and other communications to you concerning this Program and your participation therein. Under this Program, an Eligible Referrer is able to use a BookEazy fillable form web interface to transmit emails and SMSes to Eligible Friends and to receive automatic updates about their Eligible Friends' participation, including but not limited to email address, SMS, delivery confirmation of email invitation to referral, and other information about the Eligible Friends as related to the administration of the Program. By participating in either Program, an Eligible Referred Friend agrees that BookEazy may share such information with the Eligible Referrer (Member). Program participants agree to not use either program to transmit spam or any other communication that is unrelated to this Program or that is not for the purpose of promoting BookEazy's services, as determined in BookEazy's sole discretion. BookEazy is not responsible for any incorrect or inaccurate information supplied by customers or referred friends while participating in the Program.

By participating in this Program, you agree to BookEazy's collection, use, and disclosure of any personal information you may submit for the purposes of administering the Program and Referral Rewards, set forth in these Terms and Conditions, and set forth in our Privacy Policy. To learn additional information on how the personal information collected in connection with the Program may be used, individuals should refer to the BookEazy Privacy Policy. The terms of the BookEazy Privacy Policy are incorporated herein by reference.

All questions or disputes regarding eligibility for the Program, earning of Referral Rewards or credits, or a member's compliance with these Terms and Conditions will be resolved by BookEazy in its sole discretion.

Any Referral Rewards or credits are net of taxes and you must pay any applicable taxes.

This Program is void where prohibited by law. This Program and these Terms and Conditions are subject to all applicable state and local laws and regulations.

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.

Limitation of Liability & Disclaimers

BY PARTICIPATING IN THE PROGRAM, PARTICIPANTS AGREE TO RELEASE, INDEMNIFY, DEFEND, AND HOLD HARMLESS BOOKEAZY TECHNOLOGIES PRIVATE LIMITED, AND ALL OF ITS AFFILIATES, CONTRACTORS, SUBSIDIARIES AND EACH OF THEIR RESPECTIVE AGENTS, REPRESENTATIVES, OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, EMPLOYEES AND ASSIGNS‭ (‬COLLECTIVELY,‭ "‬RELEASEES‭") FROM AND AGAINST ANY INJURIES, LOSSES, DAMAGES, COSTS, EXPENSES, CLAIMS, ACTIONS, AND LIABILITY OF ANY KIND RELATING TO OR ARISING OUT OF YOUR PARTICIPATION IN THE PROGRAM OR ACCEPTANCE, POSSESSION, USE, MISUSE OR NONUSE OF ANY REWARDS OR CREDITS YOU RECEIVE OR BELIEVE YOU SHOULD RECEIVE. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES, COSTS, EXPENSES AND DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, GENERAL, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. TO THE EXTENT THAT THE LAWS OF CERTAIN STATES DO NOT PERMIT THE LIMITATION OR ELIMINATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES, OR IF A PARTICIPANT PROVES WITHIN A COURT OF COMPETENT JURISDICTION THAT BOOKEAZY HAS IMPROPERLY DENIED THAT PARTICIPANT OF REWARDS OR CREDITS, LIABILITY WILL BE LIMITED TO THE EQUIVALENT VALUE OF ONE (1) PAISE. BY PARTICIPATING IN THE PROGRAM, PARTICIPANTS WAIVE ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS, INCLUDING A CLAIM OF AMBIGUITY IN THESE TERMS AND CONDITIONS, IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED.

PARTICIPANTS AGREE THAT RELEASEES HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, CONDITION OR GUARANTEE, WHETHER STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE PROGRAM OR ANY CREDITS. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, BOOKEAZY DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE BOOKEAZY WEBSITE, AND BOOKEAZY SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. RELEASEES ARE NOT RESPONSIBLE FOR PRINTING OR TYPOGRAPHICAL ERRORS IN ANY MATERIALS RELATED TO THE PROGRAM; FOR STOLEN, LOST, LATE OR MISDIRECTED CREDITS; OR FOR REFERRALS, TRANSACTIONS AND/OR EMAILS THAT ARE LOST, MISDIRECTED, FAIL TO ENTER INTO THE PROCESSING SYSTEM, OR ARE PROCESSED, REPORTED, OR TRANSMITTED LATE OR INCORRECTLY OR ARE LOST FOR ANY REASON INCLUDING COMPUTER, TELEPHONE, PAPER TRANSFER, HUMAN OR OTHER ERROR; OR FOR ELECTRONIC, COMPUTER, OR TELEPHONIC MALFUNCTION OR ERROR, INCLUDING INABILITY TO ACCESS ANY WEBSITE ASSOCIATED WITH THIS PROGRAM, OR PROCESS ANY TRANSACTION THEREON.

TERMS AND CONDITIONS FOR GIFT MEMBERSHIPS

1. Redemption. Gift Memberships must be redeemed through the BookEazy.com Website, http://www.bookeazy.com, towards the purchase of eligible membership plans.

2. Expiry: The expiration date for redemption of Gift Memberships will be no later than six months from the date of purchase.

3. Limitations: * Gift Memberships cannot be redeemed for purchases of any other items or goods. * Gift Memberships cannot be used to purchase other Gift Memberships * Gift Memberships cannot be reloaded, resold, used in part, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law.

4. Our Policies: Gift Memberships and their use on the BookEazy.com Website are subject to BookEazy.com's general Terms of Use and Privacy Policy. BookEazy.com may provide the person gifting the membership with information about the redemption status of Gift Memberships.

5. Risk of Loss: The risk of loss and title for Gift Membership pass to the purchaser upon our electronic transmission to the recipient or delivery to the carrier, whichever is applicable. We are not responsible for lost or stolen Gift Memberships.

6. Fraud: BookEazy.com will have the right to close customer accounts and request alternative forms of payment if a fraudulently obtained Gift Membership is either redeemed through the BookEazy.com Website or is redeemed and used to make purchases on the BookEazy.com Website.

7. Limitation of Liability. BOOKEAZY AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CERTIFICATES, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT MEMBERSHIP CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT MEMBERSHIP.

8. Arbitration. Any dispute relating in any way to BookEazy.com Gift Memberships shall be submitted to confidential arbitration in Pune, India, except that, to the extent you have in any manner violated or threatened to violate BookEazy.com's intellectual property rights, BookEazy.com may seek injunctive or other appropriate relief in any state or federal court in Pune, and you consent to exclusive jurisdiction and venue in such courts. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

9. General Terms. BookEazy.com reserves the right to change these terms and conditions from time to time in its discretion. All terms and conditions are applicable to the extent permitted by law.

OTHER TERMS

Interpretation

Words denoting the singular number shall include the plural number and vice versa and words denoting the masculine gender shall include both other genders. Any reference in this Agreement to clauses or appendices shall mean a reference to clauses and appendices to this Agreement. The headings to Clauses or Sub-clauses are for convenience only and shall not affect the interpretation of this Agreement. Wherever the context requires the terms/expressions defined herein shall include their respective grammatical variations and cognate expressions. Any other word or term used herein shall carry the respective meaning assigned to it in its ordinary applicability and essence or in its respective technical, customary and commercial parlance or usage.

Entertainment Content

We distribute movie, and other entertainment tickets and we reserve the right to display and promote the entertainment or other information on our Website to you in any manner we choose in our sole and absolute discretion. In addition, the BookEazy Website allows you and other third parties to post reviews or comments concerning the entertainment distributed by us. Any opinions, advice, statements, services, offers, or other information that constitutes part of the content expressed or made available by third parties on the BookEazy Website are those of the respective authors or producers and not of BookEazy., or its shareholders, directors, officers, or employees. Under no circumstances shall BookEazy, or its shareholders, directors, officers, directors, or employees be held liable for any loss or damage caused by your reliance on information obtained through the BookEazy Website. It is your responsibility to evaluate the information, opinion, advice, or other content available through the BookEazy Website.

Information submitted

Should you send any unsolicited materials or ideas, you do so with the understanding no additional consideration of any sort will be provided to you, and you are waiving any claim against BookEazy and its affiliates regarding the use of such materials and ideas, even if material or an idea is used that is substantially similar to the idea you sent.

Trials

From time to time, we test various aspects of our service, including service levels, plans, promotions and pricing, and we reserve the right to include you in or exclude you from these tests without notice.

Electronic Communication

By using the BookEazy service, you consent to receiving electronic communications from BookEazy. These communications will include notices about your account (e.g., shipping and receiving e-mails and other transactional information). These communications are part of your relationship with BookEazy and you receive them as part of the BookEazy subscription. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

In addition, member can subscribe to receiving information concerning or related to our service, such as featured films, Theatre promotions, promotions by our retail partners, or other entertainment information or offerings.

Identification

In order to provide you with ease of access to your account, BookEazy will place a cookie (a small text file) on any computer from which you access the BookEazy Website. When you revisit the BookEazy Website, this cookie will enable us to recognize you as the account holder and provide you with direct access to your account without requiring you to retype any password or other user identification. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account.

You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You may choose to share your account with other people by providing them your password. However, if you decide to share your account with other people, you take full responsibility for their actions. If you find that you're a victim of identity theft and it involves a BookEazy account, you should notify customer service. Then, you should report this instance to all your credit card issuers, as well as your local law enforcement agency. BookEazy reserves the right to place any account on hold anytime with or without notification to the subscriber in order to protect itself and its partners from what it believes to be fraudulent activity. BookEazy is not obligated to credit or discount a membership for holds placed on the account by either a representative of BookEazy or by the automated processes of BookEazy.

Conduct

By accessing the BookEazy Website, you agree not to upload, post, e-mail or otherwise send or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the BookEazy Website. You also agree not to interfere with the servers or networks connected to the BookEazy Website or to violate any of the procedures, policies or regulations of networks connected to the BookEazy Website, the terms of which are incorporated herein. Limitations

You must be 18 years of age or older to subscribe to the BookEazy service. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. While BookEazy does distribute products that may be watched by children, we do not intentionally seek to collect information from individuals 13 years of age and younger (see also "Profiles" below). Unless otherwise specified, the content on the BookEazy Website is for your personal and non-commercial use and we grant you a limited license to access the BookEazy Website for that purpose. The compilation of all content on this site is the exclusive property of BookEazy, and protected by the Indian and international copyright laws. Content shall not be reproduced or used without express written permission from BookEazy, or its suppliers. You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the BookEazy Website, not to insert any code or product or manipulate the content of the BookEazy Website in any way that affects the user's experience, and not to use any data mining, data gathering or extraction method. We assume no liability or responsibility for any errors or omissions in the content of the BookEazy Website, any failures, delays, or interruptions in the booking of tickets, delivery of any content contained on the BookEazy Website, any losses or damages arising from the use of the content provided on the BookEazy Website, or any conduct by users of the BookEazy service or Website. Failure of BookEazy to provide continued or uninterrupted exchange of Booking information to our partner Theatres shall not amount to a default of BookEazy or create any liability on it in pursuance thereof.
